New Bond Release and Dispute Process Introduced

A new bond release and dispute process has officially been introduced, marking the final stage of reforms to the Residential Tenancies Act announced in May 2023.

The updated system allows property managers, landlords, and tenants to apply for the release of a rental bond at the end of a tenancy. If there is any disagreement over the bond, the matter will now be handled through a Commissioner-led determination process instead of the court system.

Faster and More Consistent Dispute Resolution

Under the previous system, bond disputes were handled through the Magistrates Court, which often resulted in long delays and inconsistent outcomes.

With the new process, most disputes will be reviewed through a Commissioner determination, aiming to deliver quicker and more consistent decisions. Outcomes will also be published online by Consumer Protection, helping provide clearer guidance for both the property industry and the wider community.

However, the efficiency of this system will depend on whether the Consumer Protection division is adequately resourced to manage the cases.

Important Advice for Tenants

Tenants are advised not to rush into applying for their bond immediately after moving out. Doing so will not speed up the process and may actually cause delays.

There are still important steps that must be completed first, including:

  • Final property inspection
  • Review of the property condition report

The fastest way to receive a bond refund is for all parties to communicate, resolve any issues, and reach an agreement before submitting an application.

Increase to Pet Bond

As part of the changes, the pet bond has been increased from $260 to $350. It can now also be used for a broader range of expenses beyond just fumigation.

Ongoing Balance Between Tenants and Investors

While there are ongoing concerns around rental reforms and their potential impact on housing supply, the new bond process is seen as a positive step.

The changes aim to create a fairer and more efficient system, while maintaining a balance between the rights of tenants and property owners.
